Chapter 460-2. PROHIBITION OF DISCRIMINATION |
§ 460-2.022. Enforcement.
(a)
Mediation by Human Relations Commission. Any person who believes that he or she has been discriminated against in violation of the provisions of this chapter may file with the human relations commission a request to have the commission investigate and mediate his or her complaint pursuant to procedures adopted by the commission.
(b)
Civil Action. Any aggrieved person may enforce the provisions of this chapter by means of a civil action.
(c)
Injunction.
(1)
Any person who commits, or proposes to commit, an act in violation of this chapter may be enjoined therefrom by any court of competent jurisdiction.
(2)
An action for injunction under this subsection may be brought by an aggrieved person or by any person who or entity which will fairly and adequately represent the interests of the protected class.
(d)
Non-Exclusion. Nothing in this chapter shall preclude any aggrieved person from seeking any other remedy provided by law.
(e)
Exception. Notwithstanding any provision of this code to the contrary, no criminal penalties shall attach for any violation of the provisions of this chapter.
(f)
This chapter shall not be interpreted or implied so as to create any power or duty in conflict with the preemptive effectiveness of any federal or state law.
