§ 55-2.1002. Non-severability.

  • (1)

    If any section of this chapter, or the application of such section to any person or circumstance, is held invalid, each and every of such provisions of this chapter shall not be deemed severable from the provisions of the ordinance codified in this division establishing the public authority and this chapter shall be held invalid in its entirety.

    (2)

    If this chapter becomes invalid under subsection (1) of this section, the public authority created by this chapter shall cease to exist and the county shall immediately resume the provision of IHSS as were provided prior to the adoption of the ordinance codified in this division.
