§ 816-2.806. Costs.

The costs of arbitration and all mandated restorative actions and/or replacement plantings shall be apportioned between the claimant and the tree owner as mutually agreed to, or in the absence of agreement as follows:
(1)

The claimant and tree owner shall each pay fifty percent of such costs in those cases involving any tree planted by the tree owner subsequent to March 1,1984.

(2)

In all other cases, the claimant shall pay one hundred percent of such costs.
